1. The individual must be an active paid Attorney Shield® member at the time of the incident.

3. The law enforcement encounter must be: (a) Police-initiated (e.g., traffic stop, roadside detention, domestic situation, investigation, etc.) and (b) Occur within the United States or its territories.
3. The member’s incident must involve a law enforcement encounter where, based on a reasonable and good faith review by Attorney Shield, it can be determined that one or more officers unnecessarily or unlawfully escalated the situation, resulting in direct out-of-pocket costs to the member. [1]
[1] For the explicit purpose of this limited warranty, “unnecessarily or unlawfully escalated” shall mean any action taken by law enforcement officer(s) that either: (a) constitutes a violation of applicable laws, regulations, or constitutional rights; or (b) while technically lawful, is deemed excessive, avoidable, or disproportionate to the circumstances, as reasonably evaluated based on the totality of the situation.

6. Warranty Limitations
- The maximum benefit is $1,000
per covered incident, limited to one (1) covered incident per individual
membership per year or one (1) covered incident per family membership per
year - This Warranty is not
transferable and applies only to the enrolled member - Attorney Shield reserves the
right to deny claims found to be fraudulent, incomplete, or unsupported
7. Maximum Benefit Proration
For members
enrolled in monthly or semiannual payment plans, the maximum benefit
available under this warranty shall be prorated based on the proportion of
the membership period that has been paid as of the future renewal date.
Proration is calculated by dividing the number of active membership months paid
within the 12-months preceding the renewal date, then dividing by 12, and
applying that percentage to the $1,000 maximum annual benefit.
- Example 1: A monthly-paying member
experiences an eligible incident 3 months after signing up. Having paid 3
out of 12 months, the member would be eligible for 25% of the maximum
benefit, or $250. After 12 months of uninterrupted active
membership, a monthly-paying member would be eligible for 100% of the
maximum benefit. - Example 2: A semiannual-paying member who
recently renewed for another 6 months would be considered an active member
for the 12 months preceding the updated renewal date, and thus eligible
for 100% of the $1,000 maximum benefit. Alternatively, a new
semiannual member would only be eligible for 50% of the maximum benefit
or $500 since within the preceding 12 months of the renewal date,
the member has only paid Attorney Shield® for 6 months. - Example 3: An annual-paying member is
eligible for 100% of the maximum benefit immediately upon signup or
renewal, regardless of when the incident occurs within that year.
